Who are we?

ArtAssistant NV, 8310 Brugge, Gemeneweideweg-Noord 9 (Belgium), registered with the Crossroads Bank for Enterprises under number 0668.582.990 Register of Legal Entities of Gent, department Brugge and with VAT-number BE 0668582990 (hereinafter: “ARTASSISTANT”, “We”, “Our”, or “Us”) is responsible for the processing of personal data collected and processed on this Platform.

Which personal data do we collect and how?

We collect the following personal data from the visitors of our Platform (hereinafter “User” or “Users”) (e.g. when they register an account, complete a form available on our Platform and/or use the services provided on our Platform):

  1. Contact details (name, e-mail address, language, country, (delivery) address, VAT-number);
  2. Unique identifiers (username, password);
  3. Preferences and selection behaviour, activities on our Platform, transaction history;
  4. Data concerning your general usage of our Platform and your technical preference settings when using our Platform;

Without the provision of the personal data mentioned under 1-4 above, you cannot make use of our Platform. The personal data mentioned under 5 above is collected through the use of cookies. For more information with respect to the cookies we use and your possibility to disable them, we refer to our cookie notice below.

Our Platform allows our Users to make payments. For such payments ARTASSISTANT relies on a third party payment provider. The third party payment provider may collect and process personal data (such as credit card number) through the Platform to process your payments. Such data is not collected by or shared with us. We do not come into possession of this personal data at any time.

What do we use the personal data for?

We use this personal data for the following purposes:

  • To provide you with the information, customer support, products and/or services (as described in the ARTASSISTANT General Terms and Conditions) (hereinafter the “Services”) you request from us;
  • To process sales and purchasing orders;
  • To carry out obligations arising from third party contracts concluded by us in order to provide the Services to our Users;
  • To improve our customer support, products and/or Services towards our Users;
  • To send newsletters and other direct marketing messages to our Users;
  • To detect, prevent or otherwise address fraud, security or technical issues;
  • To respond to claims against us or comply with any law, regulation, legal process or governmental request.

We also use your personal data to create your personal profile (based on your account preference settings, the selections and/or transactions you make on our Platform) in order to improve our Services towards you and to be able to better propose products or Services (e.g. artists, artworks, etc.) which could be of interest to you.

Personal data concerning health, political ideas, religion, ethnicity, sexual preferences or criminal records are considered as special category data or “sensitive data”. In principle, we do not collect any sensitive data. If, for any reason, you would choose to share sensitive data with us, we consider this your explicit consent to process this data in accordance with this privacy notice.

Minor?

Minors are not allowed to use our Services.

Who do we share your personal data with?

We may share your personal information:

  • With another User in order to process a sales or purchasing order between you and that User;
  • When we are required by law to do so;
  • With the processor(s) which we have contracted to facilitate the functioning of our platform and to provide you with the Services;

We will only share your personal data with the third parties as described in the previous paragraph. We do not sell personal data to third parties.

The Platform may include links and other features which enable access to and/or depict other websites or services, and other websites or services may include links to our Services. Please note that our privacy notice does not apply for the processing personal data done on these websites and/or services. We advise our Users to carefully read the privacy notices of the concerned websites and/or services to be informed about the processing of their personal data on such websites and/or services.

How long do we store your personal data?

We will not store your personal data longer than is required to achieve the purposes described in this privacy notice. We will not store your data outside of the European Union.

Your rights with respect to your personal data

You have the right to request access to your personal data and to request information about the processing of your personal data. You have the right to have inaccurate personal data rectified, to have incomplete data completed by providing a supplementary statement and to request the deletion of your personal data.

You have the right to object to the processing of your personal data or to have the processing restricted. If you have consented to any processing of personal data by us, you have the right to withdraw your consent at any time.

You have the right to request a copy of the personal data you have provided us with, to receive this in a structured manner and to request us to transfer your personal data to another controller.

We will answer to your request in accordance with the legal conditions of these rights and reserve the right to verify your identity in order to prevent unlawful access to your personal data. You can also access, rectify and/or delete certain personal data concerning you via your personal account on the Platform.

If you are of the opinion that your privacy rights have not been respected, you can file a complaint with the competent supervisory authority in the European Member state in which you are residing, working or where you believe the infringement of your privacy has taken place.

You can exercise all rights described above without any charge.

How do we safeguard data?

We have taken the necessary technical and organizational measures to protect your personal data against unlawful access, loss or abuse.

Cookies?

We use session cookies on our Platform to provide you with a better usage experience (e.g. to remember you are logged in during your session). Session cookies are used to ensure that the answers and information you give is tracked while you are logged in. Once you log out or quit your browser, session cookies are automatically deleted.

We use tracking cookies on the website. Data on how you use our Platform (incl. your IP-address and device logging data, such as browsertype; general usage of the Platform, such as which pages you visit and how long you visit them, etc.). This is done to analyse how you use our Services and customize and improve our Services for our Users.
